Why should I use an Attorney to help me with my Social Security Disability case?

Derrell Payne, former Pubic Relations Manager with the Social Security Adminstration had this to say:

“Think of it this way, if you needed major surgery would you go to someone who has not had formal training or would you go to a board certified doctor to render surgery on you? Quite naturally you would want to take your chances with a professional–someone that has been educated, a board certified professional trained to take care of your ailment. Now if you are in need of legal assistance and believe me social security disability cases are based on federal rules and regulations/statutes I would go with the trained attorney to assist me with my social security disability claim, it only makes good sense.

Attorneys are educated legal professionals. Attorneys must pass the bar exam in order to practice law. This in itself demonstrates a level of competency and familiarity regarding laws, and regulations. Attorneys are aware of legal statues, regulations, and legal procedures to assist you in acquiring your social security disability benefits. If your social security disability claim goes to civil court you must have an attorney represent you. Attorneys are also familiar with court room procedures. If you have to appear in front of an administrative law judge at the hearing level, the attorney’s knowledge of the legal system is very important. An attorney receives certification from the bar that they are allowed to practice law. Ask for your attorney to show you their certification document. Most of the time the certification is posted prominently in their law offices.

An advocate could be anyone. Most advocates don’t have a legal education, nor legal background. After reading this, now you can make the right decision on who you think would best represent you, regarding your social security disability claim?

Reconsideration Appeal

What is a reconsideration appeal?

Reconsideration appeal is a complete review of your claim by someone who was not involved with your case when the first decision or initial decision was made. Social Security will look at all the evidence that was submitted when the initial decision was made plus any new information you have submitted as a part of your reconsideration appeal.
