There is no fee unless you win.
How we help
Dayton Claims Handled by Phone or Video From Tennessee
Consultations happen by phone or video, and our attorneys handle hearings from Tennessee by phone or video.
Wright-Patterson Air Force Base's 88th Air Base Wing page says approximately 30,000 military members, civilian and government contractor employees work on the base, and it ties the base's economic impact to the greater Dayton region. A claimant who served there, or who held a federal civilian job there, can face rules from the VA or the Office of Personnel Management alongside Social Security's own, and the Wright-Patterson section below sets those out.
We handle applications, reconsideration, hearings and Appeals Council review for SSDI claims and SSI claims, and we respond within 3 business hours.
We have no Dayton office. Consultations happen by phone or video, and our attorneys handle hearings from Tennessee by phone or video. We represent adults age 18 and older. We handle SSDI cases for people who receive VA benefits, but we do not handle VA claims or appeals. We do not take disability cessation or continuing disability review cases, or cases about back pay alone, and we refer federal court appeals to affiliated counsel.
Hearing office
The Dayton Hearing Office and Its Six Field Offices
Social Security's hearing office locator data lists the Dayton hearing office at Courthouse Plaza SW, Suite 300, 10 N. Ludlow Street, Dayton, OH 45402. Six Ohio field offices are on its list: Dayton, Dayton (West), Middletown, Piqua, Springfield and Xenia.
Some neighboring field offices are listed elsewhere. The same data puts Hamilton under the Cincinnati hearing office, Lima under the Toledo hearing office and Chillicothe under the Columbus hearing office. A claimant who lives near the edge of the Dayton area should read the office named on Social Security's hearing notices rather than assume Ludlow Street.
The field office list is a directory, not the deciding rule. Social Security's operations manual, POMS GN 03103.040, says hearing office jurisdiction is determined by the claimant's residence address, and that the servicing office keeps jurisdiction even if the claimant has a representative whose office is in another hearing office's service area. HALLEX I-2-0-70 says a hearing office will generally process all requests for hearing for claimants residing in its area. Our hearing office directory covers every office, and our Ohio disability lawyer page covers the offices that decide claims elsewhere in the state.
Hearing formats
How a Dayton Hearing Is Held
Deadline
30days
20 CFR 404.936
Social Security offers hearings by phone, online video, agency video or in person. Its hearing options page describes agency video as using Social Security's video equipment at one of its offices, and online video as using a smartphone, tablet or computer with an internet connection from a private location you choose.
Social Security sets the format and tells you in a notice before it schedules the hearing. Under 20 CFR 404.936 for SSDI and 20 CFR 416.1436 for SSI, that notice says you may be scheduled by audio or agency video, or by online video if you agree. To object to an audio or agency video appearance, notify Social Security in writing within 30 days after you receive the notice. To appear by online video, agree in writing within the same 30 days. You may withdraw that agreement any time before the hearing starts. Our page on disability hearings covers what happens once the judge opens the record.
Local treatment records
Medical Records From Miami Valley Hospital, Kettering Health and the Dayton VA
Miami Valley Hospital: its health system's medical records page lists Miami Valley Hospital, Atrium Medical Center in Middletown and Upper Valley Medical Center in Troy. A formal copy of hospital records can be requested in MyChart through the Sharing Hub, and finished records appear in the Document Center under My Record. Outside MyChart, the Release of Medical Information form comes in English and Spanish, and the page says all forms must be signed before they can be processed. Miami Valley Hospital's Health Information Management Services office is at One Wyoming St, Dayton, OH 45409, email mvhroi@premierhealth.com, phone (937) 208-2800. The same office handles Good Samaritan Hospital records for services before July 23, 2018.
The system's records FAQ says a request can take up to 30 days from the date it is received, and that older hospital records may take longer and may be mailed: Miami Valley Hospital records dated before August 1, 2009, and Good Samaritan records dated before April 1, 2010. It also says its hospitals keep a medical record for 10 years after the date of service, with inpatient psychiatric records among those kept 22 years.
Kettering Health: its medical records page asks for a completed authorization form plus a copy of your photo ID, sent to Kettering Health, Release of Information Department, 1 Prestige Place, Suite 540, Miamisburg, OH 45342, or by fax to (937) 522-8444. The Release of Information line is (937) 762-1200, and the page asks you to allow ten business days. Two lines matter for a claim. Requests for Social Security disability benefits are listed among those with no cost, if the request includes documentation that verifies the filing of the claim. And the page says the medical record does not contain imaging films such as X-rays.
VA Dayton health care: its medical records office page places Release of Information on Floor 1 at 4100 West Third Street, Dayton, OH 45428. Mail and fax requests use VA Form 10-5345a, in-person requests need a signed written request and your Veteran Health Identification Card, and records may also be requested through MyHealtheVet Secure Messaging. The page says mail and fax requests may take up to 20 business days. Radiology images can also be accessed online with an identity-verified ID.me or Login.gov account.
Wright-patterson and veterans
VA Ratings, Active Duty and Federal Civilian Jobs
Social Security usually identifies veterans automatically, and in rare instances a veteran may need to self-identify and provide the VA notification letter as proof.
Veterans and service members: Social Security's veterans page says a VA disability compensation rating of 100% Permanent & Total, or a disability that developed while on active military service on or after October 1, 2001, may make you eligible for expedited claim processing. Social Security usually identifies veterans automatically, and in rare instances a veteran may need to self-identify and provide the VA notification letter as proof. The same page says SSDI and VA disability compensation are not affected by each other, and that each agency must follow its own definition and requirements. Our veterans page covers how a VA rating and an SSDI claim relate.
Federal civilian employees: the Office of Personnel Management's FERS disability retirement page says an application for disability retirement under FERS requires an application for Social Security benefits, and that OPM will dismiss the FERS application if the Social Security application is withdrawn. For annuitants under age 62, the page says OPM reduces the FERS annuity by 100% of any Social Security disability benefit while the annuity is computed at 60%, and by 60% of it while computed at 40%, for months when you are entitled to both.
After a denial
The 60-Day Clock After a Dayton Denial
Deadline
60days
20 CFR 404.909
An initial denial gives you 60 days after you receive the notice to file a written request for reconsideration, under 20 CFR 404.909 for SSDI and 20 CFR 416.1409 for SSI. A reconsideration denial starts another 60 days for a written hearing request, under 20 CFR 404.933 and 20 CFR 416.1433. Social Security counts the date you receive a notice as 5 days after the date on it, unless you show you did not receive it within that period, under 20 CFR 404.901 and 20 CFR 416.1401.
A late request can still be accepted for good cause. 20 CFR 404.911 and 20 CFR 416.1411 list examples, among them being seriously ill and prevented from contacting Social Security, and trying very hard to find necessary information to support the claim without finding it in time. File as soon as you can and explain in writing what delayed you. Our appeals page walks through each level.
Common questions
Dayton Disability Claim Questions
Is a Hamilton, Ohio claimant's hearing held in Dayton or Cincinnati?
Social Security's hearing office data lists the Hamilton field office under the Cincinnati hearing office, not Dayton. Jurisdiction follows your residence address, so go by the office named on your hearing notices.
Where do I get Good Samaritan Hospital records from before July 2018?
The health system's records page routes Good Samaritan Hospital records for services before July 23, 2018, through Miami Valley Hospital's Health Information Management Services office on Wyoming Street.
Will Kettering Health charge for records sent for my Social Security disability claim?
Its records page lists requests for Social Security disability benefits among those with no cost, as long as the request includes documentation that verifies the claim was filed.
What happens to my pending hearing request if I move away from the Dayton area?
HALLEX I-2-0-70 says that after a change in residence, the Hearing Office Chief Administrative Law Judge will determine and arrange any appropriate case transfer. Report the new address to Social Security right away.
Does a FERS disability retirement application require an SSDI application too?
Yes. OPM's FERS disability retirement page says the FERS application requires an application for Social Security benefits, and that OPM dismisses the FERS application if the Social Security application is withdrawn.
How does Social Security learn about my 100% Permanent and Total VA rating?
Social Security's veterans page says it usually identifies veterans automatically, and that in rare instances a veteran may need to self-identify and provide the VA notification letter as proof. Keep a copy of that letter with your claim papers.
