Alabama Disability Lawyers: The State's Largest City Has No Hearing Office

Five Social Security hearing offices decide Alabama disability claims and only four of them sit in Alabama. Huntsville, the largest city in the state, has none and is heard at Florence, about seventy miles west. Decatur, in the same metro region as Huntsville, is heard in Tennessee.

North Alabama is the part worth understanding before your notice arrives, because the office map there does not follow the population. Two cities in the same combined statistical area are assigned to hearing offices in two different states, and neither of those offices is in either city. We work from Lebanon, Tennessee, and represent Alabama claimants at all five.

Which Alabama Hearing Office Decides Your Disability Claim?

It does not track city size and it does not track driving distance.

The office that hears your Alabama case is chosen by the Social Security field office serving your address. It does not track city size and it does not track driving distance. You can ask Social Security to hear the case at a different office, with the reason in writing, and it decides whether to transfer it.

North Alabama is where that shows. Huntsville is the largest city in the state and has no hearing office; its claims go to Florence, roughly seventy miles west, whose service area is only three field offices. Decatur sits in the same combined statistical area as Huntsville, close enough to share a commute, and its claims go to Franklin, Tennessee. Two neighboring cities, two hearing offices, two states.

The border runs the other way too. The Mobile office takes claims filed at Pensacola and Fort Walton Beach, so the Florida panhandle is heard from Alabama. None of this changes the legal standard applied to your file, and a denial starts a sixty-day clock wherever your office sits.

Service area lines name Social Security field offices rather than cities or counties, which is how the assignment is actually made.

Five hearing offices decide Alabama claims: Birmingham, Florence, Franklin, Tennessee, Mobile and Montgomery. Franklin sits outside Alabama. Mobile also takes claims filed in Florida.

Medical Evidence for a Florida Disability Claim Without Coverage

That is normal and it does not disadvantage the claim.

The medical decision is not made by Social Security. It is made by Alabama Disability Determination Services, a state agency working under Social Security's rules and at its expense, from two offices, in Birmingham and Mobile. Social Security takes the application and decides the non-medical parts of the claim; DDS gathers your records and applies the federal definition of disability to them.

Two offices for the whole state is a small footprint, and it means the branch handling your file will almost certainly not be in your city. That is normal and it does not disadvantage the claim. What it does mean is that the address on your DDS correspondence tells you nothing about where your hearing will eventually be, because the hearing office is chosen by a different rule entirely.

A step that used to be skipped here

Alabama Disability Claims No Longer Skip the Reconsideration Stage

Alabama was one of ten prototype states where Social Security ran the disability process without a reconsideration stage from 1999 onward. A denial went straight to a hearing request, and for years that was correct advice in this state.

Social Security reinstated reconsideration in Alabama in October 2019, and the ordinary sequence now applies: initial decision, reconsideration, then a hearing before an administrative law judge. The practical risk is not the extra step. It is that a great deal of Alabama-specific guidance was written during the prototype years and still says the stage does not exist here. Following it means filing the wrong thing while the sixty-day clock runs.

If you are reading anything about an Alabama disability appeal, check when it was written. Our appeals page walks through the stages in the order they now apply.

Is there a hearing office in Huntsville or Birmingham?

Birmingham has one. Huntsville does not, despite being the larger city, and its claims are heard at Florence. The four Alabama offices sit in Birmingham, Florence, Mobile and Montgomery, and a fifth office in Franklin, Tennessee takes claims filed at Decatur. Where you live decides which one you get, and city size has nothing to do with it.

Why is my Huntsville claim heard in Florence?

Because Huntsville has no hearing office and its field office is assigned to Florence, about seventy miles west. Florence covers just three field offices, Cullman, Florence and Huntsville, which is the smallest service area of any Alabama hearing office and contains the state's largest city. It is not a mistake and it is not a preference you enter on a form, though a claimant can ask Social Security to change the place of a hearing and it decides that on good cause, under 20 CFR 404.936(f) and (g).

I live near Decatur. Why does my notice name a Tennessee office?

Because the Decatur field office is assigned to the Franklin, Tennessee hearing office. Decatur and Huntsville sit in the same combined statistical area, and their claims go to hearing offices in two different states. Crossing that line does not change the standard applied to your file, which is federal and does not change with the office.

Does Alabama still skip the reconsideration step?

No, and this is worth checking any advice you find. Alabama was one of ten prototype states where Social Security ran the disability process without a reconsideration stage, so a denial went straight to a hearing request. Social Security reinstated the step here in October 2019. Guidance still telling Alabama claimants to skip reconsideration is describing a process that no longer applies, and following it can cost a stage.

Which agency actually decides whether I am disabled?

Alabama Disability Determination Services, a state agency working under Social Security's rules and at its expense, under 20 CFR 404.1603, from offices in Birmingham and Mobile. Social Security takes the application and decides the non-medical parts; DDS gathers your records and applies the federal definition of disability to them, a process SSA describes at its disability determination page. A judge does not see the file until later, and only if you appeal.

Is the Florida panhandle really served from Mobile?

Yes. Pensacola and Fort Walton Beach are Florida field offices assigned to the Mobile hearing office, so those claims are decided in Alabama. It is the mirror image of what happens at the top of the state, where Decatur is decided in Tennessee. Alabama sends one field office north and takes two from the east.
