Huntsville Disability Lawyers for SSDI and SSI
Downard & Associates represents adults in Huntsville, Alabama, with Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI) applications and appeals. We work with clients by phone and video, including preparation for administrative hearings. Start by listing the hospitals, clinics, and doctors that treated you and how your condition affects your work. If you have been denied, save the full decision letter and note when you received it so the next appeal step can be reviewed.
How we help
How We Develop a Huntsville Application or Appeal
For SSI, we also help complete the application and its financial disclosures.
A claim needs more than the name of a medical condition. Our work connects the application or appeal with the supporting evidence and the limits that affect your ability to work.
Application: We help prepare and submit the SSDI application and gather initial medical evidence, including treatment records. For SSI, we also help complete the application and its financial disclosures.
Reconsideration: We review the reasons for denial, file the reconsideration appeal, and seek additional or updated medical evidence. The reasons in the decision help identify what needs to be addressed.
Administrative hearing: We develop the medical record, prepare you to testify about your symptoms and limitations, and present your case at the hearing.
Our service limits also address matters involving Department of Veterans Affairs (VA) benefits.
We handle SSDI cases for people who currently receive VA benefits, but we do not handle VA claims or appeals. We do not take disability cessation or continuing disability review cases, or new cases involving back-pay issues alone. We refer federal court appeals to a trusted affiliate rather than handling them in-house.
Benefit eligibility
Understanding SSDI and SSI Eligibility in Huntsville
Duration rule
12months
SSDI generally requires enough recent work in jobs covered by Social Security. The work credits you need depend on your age when disability began; younger workers may qualify with fewer credits. The Social Security Administration (SSA) explains the insured-work requirements in its disability eligibility guidance.
SSI does not require an insured work history. It requires limited income and resources, plus eligibility based on age 65 or older, blindness, or a qualifying disability. Citizenship, residency, and other program requirements also apply. See SSA's SSI eligibility rules.
For SSDI and adult SSI claims based on disability, SSA evaluates whether a medically determinable condition prevents substantial gainful activity, or SGA. Past work and adjustment to other work are considered when the claim reaches those steps. SSA can decide a claim at an earlier step, so not every claim reaches the final step.
Both the condition and the resulting inability to perform SGA must generally have lasted, or be expected to last, at least 12 consecutive months, unless the condition is expected to result in death within 12 months of disability onset. SSA's duration guidance explains this rule. You do not have to wait 12 months before applying.
SSI based on statutory blindness has different rules: SGA is not used to determine initial eligibility, and statutory blindness has no duration requirement under SSI. Income, resource, and other SSI requirements still apply. Age-based SSI eligibility does not require proving disability.

Treatment records
Choosing the Right Huntsville Hospital or Crestwood Records Request
Records not included in the portal must be requested from Medical Records.
Huntsville Hospital's medical-records page provides separate request links for Huntsville Hospital, Women & Children, Madison Hospital, and the Physician Network. Choose the link that matches where you received care. A hospital stay and a physician-network appointment should each appear on your treatment list.
The hospital says its patient portal contains a summary of an inpatient stay. Records not included in the portal must be requested from Medical Records. Compare what you can see online with the dates and providers on your list rather than treating the portal summary as your entire file.
For mailed Huntsville Hospital requests, the instructions require a signed and dated authorization, specific dates of service or a date range, and a copy of valid photo identification. Requests for radiology CD images or film go through Imaging Services. If an image copy is needed, follow that separate instruction.
Crestwood also separates requests for the Medical Center from requests for its Medical Group. Use its current medical-records instructions to select the appropriate route. The page provides different locations for dropping off a request and mailing one, so check the instructions for the method you use.
Keep a separate line for each treatment source, the dates requested, and the records received. This gives you a way to identify missing visits or reports and explain where additional evidence can be obtained.
Get organized
Build a Treatment-to-Work File for Your Huntsville Claim
Use this checklist to connect the medical information with your work history. You can begin with the information already available.
Treatment sources: Record each doctor, clinic, and hospital, with contact information, patient numbers if known, and treatment dates. Identify hospital care separately from physician-network or medical-group visits.
Tests and medications: List test dates, who ordered the tests, current medications, and who prescribed them. Note which reports you already have.
Jobs and tasks: List recent jobs and dates, then describe the duties your condition affects. Use specific examples, such as limits on sitting, standing, lifting, concentrating, or keeping a regular schedule.
Changes over time: Note when symptoms affected your work, changes in hours or duties, and the treatment that followed. Describe your own experience accurately.
Record requests: Track each provider, the treatment period requested, and what arrived. Keep any request confirmation and mark gaps for follow-up.
SSI information: If SSI is involved, organize income and resource information as well as the medical evidence. Financial eligibility is a separate part of the claim.
SSA's application preparation guidance lists the information to gather and says not to delay applying because documents are missing. You do not need a complete medical-record file before starting.
After a denial
Identify the Next Step After a Huntsville Disability Denial
Deadline
60days
For an initial SSDI or SSI denial, reconsideration is generally the next appeal step. After an unfavorable reconsideration determination, you may request an administrative law judge hearing. A written request at either stage is generally due within 60 days after you receive the relevant notice. SSA's reconsideration rules for SSDI and SSI explain the receipt-based deadline, as do the SSDI and SSI hearing rules.
SSA generally presumes that you received the notice five days after its date unless you show that you did not receive it within that period. Keep evidence of delayed delivery. This is not an unconditional 65-day deadline from the date printed on the letter.
If a reconsideration or hearing request is late, request an extension in writing and explain why. SSA must find good cause to extend the filing period; extra time is not automatic. The decision's review stage and instructions matter when deciding what to file.
Hearing preparation
Prepare for Your SSA Hearing From Huntsville
SSA describes four ways to attend a hearing: in person, by telephone audio, by agency video using SSA equipment, or by online video using your own device. Online video requires your agreement. Objections to audio or agency video follow SSA's rules and exceptions; respond to the appearance notices within their stated time limits.
Follow your scheduling notice for the time, location, and attendance instructions. An in-person hearing may take place at a hearing office or another SSA hearing site. Phone or video meetings with our team are separate from SSA's hearing arrangements.
Our hearing-office guide provides broader office information. Use the instructions for your own case when preparing to attend.
Common questions
Questions About Huntsville Disability Representation and Records
Can I work with Downard from Huntsville?
Yes. We represent adults in Huntsville and work with clients by phone and video. Those meetings do not determine how you attend an SSA hearing; SSA's appearance rules and your scheduling notice govern that proceeding.
Is a Huntsville Hospital portal summary enough to organize my records?
Use it as a starting point. Huntsville Hospital says records not included in its portal must be requested from Medical Records. Check the summary against your treatment list and identify any hospital, clinic, or physician records that are still missing.
Should I wait a year or collect every record before applying?
No. For disability-based claims, both the condition and the resulting inability to perform substantial gainful activity must generally have lasted, or be expected to last, at least 12 consecutive months, unless the condition is expected to result in death within 12 months of disability onset. You do not have to wait a year to apply. SSA also says not to delay applying because documents are missing. SSI based on statutory blindness has no duration requirement.
What should I explain about work if I already have a diagnosis?
Describe the tasks you performed and the limits your condition causes. For an adult disability-based claim, SSA evaluates medical evidence and work activity, with past work and other work considered when the claim reaches those steps. A diagnosis alone does not establish eligibility. SSI based on age or statutory blindness has different rules.
