Nebraska Disability Lawyers: The First State Enforcing the Medicaid Work Rules, and the Exemption Is Everything

Nebraska began enforcing the federal Medicaid work requirement on May 1, 2026, ahead of every other state. Expansion adults aged 19 to 64 must show 80 hours a month of activity under 42 CFR 435.552 unless they qualify for an exemption, and being medically frail is one.

For most of the country this is still a rule arriving in 2027. Here it is already being applied at renewal, which means a Nebraskan waiting on a disability decision is dealing with the exemption question now rather than reading about it later. Everything turns on that exemption, and the state can only apply it from what it has on file. One hearing office decides Nebraska claims, in Omaha.

Why Nebraska is ahead

The Medicaid Work Requirement and a Nebraska Disability Claim

The state's own materials describe it as applying to able-bodied adults in the expansion group and set out a list of exemptions alongside it.

Because the state chose to move early. Federal law passed in 2025 requires every state running expansion coverage to condition it on 80 hours a month of work, training, community service or qualifying income, or enrollment at least half time in an educational program, which counts on its own. Implementation is due no later than January 2027. Nebraska went first, on May 1, 2026.

Worth setting expectations before the detail: this is not a rule aimed at people who cannot work. The state's own materials describe it as applying to able-bodied adults in the expansion group and set out a list of exemptions alongside it. The difficulty is not the rule's intent, it is that an exemption the state has no information about does nothing for you.

The requirement reaches adults aged 19 to 64 in the expansion population. Anyone applying on or after May 1, 2026 has to show qualifying activities or an exemption when they apply, and people already enrolled are assessed at their regularly scheduled renewal rather than all at once.

The exemption is the whole question

Nebraska Medicaid Exemptions for Disability Claimants Who Cannot Work

The list is longer than most people assume and being medically frail is on it. Nebraska's published exemptions also cover pregnancy, caring for a child aged 13 or under, caring for a person with a disability, being in a household that meets food assistance or cash assistance work rules, taking part in a qualifying drug or alcohol treatment program, and recent release from jail.

Nebraska says proof of an exemption may be required, and that sentence is the whole difficulty for someone in the middle of a disability claim. The medical evidence that supports the claim is often the same evidence that supports the exemption, which means the work is not doubled so much as used twice.

We can tell you what the published exemptions are and what kind of documentation tends to satisfy that sort of requirement. What nobody can tell you from the outside is whether a particular case will be treated as exempt, because that is a state eligibility decision made on a file we do not hold.

What a coverage gap does to the claim

Why Losing Coverage Weakens a Nebraska Disability Claim

It thins the record, and the record is what the claim is decided on. Social Security reads the whole file, medical evidence above all, and that comes from appointments, and Social Security can pay for an examination itself when the file needs one.

Months with no visits, no imaging and no specialist opinion leave less on the record. Social Security's rules require it to consider why treatment was limited, including affordability, so the gap has to be explained rather than left to speak for itself.

That is why a coverage problem during the wait is also an evidence problem, and why the months while an appeal is pending are the months a case is built or lost.

What an approval changes

How a Disability Approval Affects Nebraska Medicaid Coverage

It generally takes you outside the group the requirement is written against, since that group is defined as expansion adults without a disability. It is not automatic. Nebraska still makes its own Medicaid eligibility decision, and the disability categories have their own rules.

So the disability decision does more than settle a monthly payment here. It changes which set of rules your health coverage sits under, and that is worth understanding while the claim is pending rather than discovering afterwards.

The hearing office

The Hearing Office That Decides Nebraska Disability Claims

Service area lines name Social Security field offices rather than cities or counties, which is how the assignment is actually made.

One hearing office decides Nebraska claims: Omaha. Omaha also takes claims filed in Iowa.

Every field office assignment and office address is on our hearing office routing page.

Average wait times change from month to month. Social Security publishes the average wait time for each hearing office and updates it monthly, so check the office that takes your claim.

I cannot work. Do the Nebraska Medicaid work rules apply to me?

Possibly not, but the exemption has to be evidenced rather than assumed. The requirement applies to adults aged 19 to 64 in the expansion group, and the state lists exemptions including people who are medically frail, people caring for a child aged 13 or under, and people caring for someone with a disability. Nebraska says proof of an exemption may be required, so the documentation matters as much as the fact.

What counts as an exemption in Nebraska?

The state's own list covers more ground than most people expect. Alongside being medically frail it includes pregnancy, caring for a young child or for a person with a disability, being in a household meeting food assistance or cash assistance work rules, taking part in a qualifying drug or alcohol treatment program, and recent release from jail. It is not a short list and it is worth reading before concluding you are outside it.

When will the state check my case?

At renewal, if you are already enrolled. Nebraska assesses existing members during their regularly scheduled renewal rather than all at once, so the date that matters is your own renewal month. Anyone applying on or after May 1, 2026 has to show qualifying activities or an exemption at the point of applying.

If my disability claim is approved, do the work rules still apply?

A disability finding generally takes a person outside the group the requirement is written against, because that group is defined as expansion adults without a disability. It is not automatic. Nebraska still makes its own Medicaid eligibility decision, and the categories for people with disabilities carry their own rules. That is a real consequence of the disability decision beyond the monthly benefit, and it is worth understanding while the claim is still pending rather than afterwards.

Why does losing coverage matter to my disability claim?

Because the claim is decided on the whole record, medical evidence above all, and records come from appointments. Months with no visits, no imaging and no specialist opinion leave a decision-maker less to read. Social Security's rules require it to consider why treatment was limited, including whether you could afford it, so a gap is explained rather than assumed against you. Coverage is what makes those appointments possible, which is why a coverage problem during the wait is also an evidence problem.

Omaha's hearing office covers the whole state. What about the Iowa border cities?

They come to Omaha. The Council Bluffs and Sioux City field offices are both in Iowa and both are assigned to the Omaha hearing office, which is ordinary for a metro area that straddles a river. Social Security's hearing office locator files them under a Nebraska heading, which is a labeling error in that document rather than anything about your claim.
