Wisconsin Disability Lawyers: Workers' Compensation Should Not Be Reducing Your Social Security Here

Wisconsin is one of a small group of states where the state reduces workers' compensation instead of Social Security reducing your benefit. Wisconsin's version is the widest of the group, covering every ordinary payment type including lump sums, from temporary to permanent.

In most states a compensation claim takes a bite out of the monthly disability payment. In Wisconsin it generally does not, and the difference is money in the account rather than anything you would see in a decision letter. Three hearing offices decide Wisconsin claims and two of them are in the state.

How Workers' Compensation Affects Social Security Disability in Wisconsin

Most states on the list protect one or two categories and leave the rest exposed.

Less than almost anywhere else. The federal rule is that compensation and Social Security disability together cannot exceed a set share of past earnings, and Social Security cuts its own payment to hold that line. A small group of states had laws in place before February 1981 that reverse the arrangement, so the state reduces the compensation and the federal benefit is paid in full.

Wisconsin's version is not limited to one payment type. It covers temporary total, temporary partial, permanent total, permanent partial and lump sum payments, effective July 1, 1980. Most states on the list protect one or two categories and leave the rest exposed. Wisconsin covers the field.

There is a second sign of how settled this is. Social Security's instructions tell its own staff that an allegation of Wisconsin compensation does not require verification, a courtesy extended to almost no other state. The rules for that benefit, the one you earned through work, are set out on our SSDI claims page.

Where it goes wrong

What to Do If Wisconsin Workers' Compensation Reduced Your Disability Benefit

Raise it, because the correction reaches backward. Social Security's manual is direct about this: where the protection applies but was not considered and the reduction was imposed in error, the reduction comes off retroactive to the month the protection took effect.

That is not a small distinction. A reduction applied by mistake for a year is not simply switched off going forward, it is unwound, and the months already paid come back into the calculation. Anything Social Security owes for that period is handled as past-due benefits. past-due benefits

The reason it happens at all is that these two systems do not share a file. Nobody at the compensation insurer tells Social Security what Wisconsin's plan does, and the coding on your record has to reflect it. A claimant seeing a reduction they should not be seeing has a fixable problem, not a permanent one, and the fix is worth asking about before assuming the figure is right.

Where your case is decided

Which Hearing Office Decides Your Wisconsin Disability Claim?

It is not a preference anyone enters on your behalf, and it does not change the standard applied to the file.

One of three. Milwaukee covers the southeast, the Fox Valley and the lakeshore. Madison covers the capital, the west and the north. Superior, in the far northwest corner, is assigned to Minneapolis, in Minnesota.

Milwaukee also carries the entire Upper Peninsula of Michigan: Escanaba, Houghton, Ironwood, Marquette and Sault Ste. Marie. Five of the field offices that hearing office serves are in another state, and those claimants sit under Michigan's compensation rules rather than Wisconsin's, because that rule follows the state paying the compensation.

Which office takes your file follows the Social Security field office that serves your address. It is not a preference anyone enters on your behalf, and it does not change the standard applied to the file. You can ask Social Security to hear the case at a different office, with the reason in writing, and it decides whether to transfer it.

Three hearing offices decide Wisconsin claims: Madison, Milwaukee and Minneapolis, Minnesota. Minneapolis sits outside Wisconsin. Milwaukee also takes claims filed in Michigan.

Average wait times change from month to month. Social Security publishes the average wait time for each hearing office and updates it monthly, so check the office that takes your claim.

I am getting workers' compensation in Wisconsin. Will it reduce my Social Security disability?

It should not. Wisconsin's plan covers temporary total, temporary partial, permanent total, permanent partial and lump sum payments, which is every ordinary type of compensation payment. Where the payment comes from Wisconsin's system, Social Security's instructions are to remove the reduction or never apply it in the first place. That is the widest protection any state on the list gives.

My Social Security was reduced anyway. Is that a mistake I can fix?

Very possibly, and it is worth raising rather than accepting. Social Security's own manual tells its staff that where this protection applies but was not considered, and the reduction was imposed in error, the reduction comes off going back to the month the protection took effect. That is a correction reaching backward, not just forward, so the months already paid are part of it.

Does Social Security need proof of my Wisconsin comp claim?

Not for this purpose. The instructions say an allegation of Wisconsin compensation does not require verification, which is unusual and is a measure of how settled the state's plan is. It does not mean paperwork never matters. The medical record is a separate question and it decides the claim itself.

I live in Superior and my claim is heard in Minneapolis. Does that change the comp rule?

It does not. Superior is the one Wisconsin field office assigned to the Minneapolis hearing office, and the judge there applies the same federal rules. The compensation rule follows the state paying the compensation rather than the office holding the hearing, and a Wisconsin claim stays a Wisconsin claim in a Minnesota courtroom.

I work in Michigan's Upper Peninsula but my hearing office is in Milwaukee. Which state's comp rule applies to me?

Michigan's, if Michigan is paying the compensation. Milwaukee's hearing office takes five Michigan field offices across the Upper Peninsula, so a Michigan claimant is heard in Wisconsin routinely. Michigan is not on Social Security's list of states with this protection, so the federal reduction applies to a Michigan compensation claim even though the hearing happens in Wisconsin.

Was my claim covered if the injury was years ago?

It depends on one date. The Wisconsin plan took effect on July 1, 1980, and lump sum awards made before that date are still subject to the reduction. Anything from July 1980 onward falls under the protection. Congress later froze the national list, which is why Wisconsin's plan counts and why no state has been able to join since.
