Lynchburg, Virginia
Lynchburg Disability Lawyers for SSDI and SSI
Downard & Associates represents adults age 18 and older in Lynchburg, Virginia, with Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI) applications and appeals. We work with clients by phone and video from our Tennessee base. We help develop the application record, respond to a denial at reconsideration, and prepare and present claims at hearings. Start by identifying your treatment providers, the work your condition limits, and where your claim stands.
How we help
How We Help Lynchburg Adults Apply and Appeal
This gives the next reviewer information addressing the issues raised in the decision.
For a new application, we help prepare and file the claim, gather medical evidence, and document your work history. A useful record connects the treatment you received with the activities your condition limits.
At reconsideration, we review the reasons for the denial and work on missing or updated evidence. This gives the next reviewer information addressing the issues raised in the decision.
Before a hearing, we review likely questions with you and help develop the medical record. At the hearing, we present the legal argument supporting your claim. Preparation helps you explain your symptoms, past job duties, and daily limitations accurately.
VA refers to the U.S. Department of Veterans Affairs.
We handle SSDI cases for people who currently receive VA benefits, but we do not handle VA claims or appeals. We do not take disability cessation or continuing disability review cases, or new cases involving back-pay issues alone. We refer federal court appeals to a trusted affiliate rather than handling them in-house.
Benefit eligibility
SSDI and SSI Eligibility for Lynchburg Adults
Duration rule
12months
SSDI generally requires enough recent work covered by Social Security. The work-credit requirements depend on your age when the disability began. SSI does not require an insured work record. It has separate income, resource, and other eligibility rules and may be available based on age 65 or older, blindness, or a qualifying disability.
For SSDI and adult SSI claims based on disability, the Social Security Administration (SSA) considers whether a medically determinable condition prevents substantial gainful activity (SGA). SGA involves significant physical or mental work activities generally performed for pay or profit; SSA also evaluates earnings. If the evaluation reaches the later work-related steps, SSA considers the past work that SSA treats as relevant and your ability to adjust to other work. A diagnosis alone does not establish eligibility.
The condition must have lasted or be expected to last at least 12 consecutive months, or be expected to result in death. You do not have to wait a year before applying. Initial SSI eligibility based on statutory blindness does not use the SGA test, and SSI statutory blindness has no duration requirement. Age-based SSI eligibility does not require a disability. Read SSA's disability eligibility explanation and SSI eligibility rules.
Local claim process
Medical Review and Hearing-Office Routing for Lynchburg Claims
An in-person hearing may be held at an SSA hearing office or a permanent remote site.
Virginia's Disability Determination Services (DDS) gathers medical evidence and makes the medical disability determination for Social Security claims. SSA verifies nonmedical eligibility and handles further processing. A request for medical information from DDS concerns the medical review; it is separate from a hearing before a judge.
Check the office named in your own hearing correspondence.
The hearing office managing a case and the place where someone appears are separate questions. An in-person hearing may be held at an SSA hearing office or a permanent remote site. The scheduling notice gives the instructions for your case. Our Virginia disability guide provides statewide context, and our hearing-office guide provides office details.
SSA offers four hearing methods: in person, audio by telephone, agency video using SSA equipment, and online video using your own device. Online video requires your agreement. Objections to audio or agency video are subject to SSA rules and exceptions. The Notice of Ways to Attend a Hearing explains the agreement and objection forms and response deadlines; the later scheduling notice identifies your hearing arrangements. Read SSA's hearing attendance options.
Get organized
Organizing Medical Records for a Lynchburg Claim
Virginia DDS asks you to report new treatment, testing, medications, conditions, and other sources of medical information. Its claimant instructions identify your assigned analyst as the contact for claim questions; the analyst's contact information appears at the bottom of a DDS letter. If you receive that letter while applying from Lynchburg, use it to direct medical updates to the person handling your review.
Keep a simple record tracker. Include information you already have and mark what still needs to be requested.
SSA's application guidance lists the medical and work information it requests. Do not delay applying solely because documents are missing. Identify the sources of that information and provide records already in your possession.
| Information | What to record | What to track |
|---|---|---|
| Each treatment provider | Name, contact information, visit dates, medications, and tests | Records available; request sent; records still missing |
| Past jobs | Job dates, duties, hours, and the physical and mental tasks involved | Tasks affected by your condition; reduced hours or other actual changes |
| New treatment or testing | Provider, date, and what changed after the application or denial | Whether the new information has been identified for your claim |
After a denial
Responding to a Lynchburg Disability Denial
Deadline
60days
After an initial SSDI or SSI denial, a written reconsideration request is generally due within 60 days after you receive the notice. After a reconsideration denial, a written request for an administrative law judge hearing is generally due within 60 days after receipt. SSA presumes receipt five days after the notice date unless you show that it arrived later. These rules concern those review stages, not every Social Security letter. See SSA's SSDI reconsideration rule and SSI reconsideration rule.
If the filing period has passed, ask for an extension in writing and explain the reasons for the delay. SSA must find good cause; an extension is not automatic. Save the decision and information showing when it arrived. Address the appeal deadline while medical-record requests are still pending.
Common questions
Questions About Lynchburg Disability Claims
Does Downard have a Lynchburg office?
No. We have no offices outside Tennessee. We work with Lynchburg clients by phone and video. Those conversations are separate from the attendance arrangements SSA schedules for a hearing.
Can I apply for SSI if I have too few work credits for SSDI?
Possibly. SSI does not require SSDI work credits, but you must meet its income, resource, categorical, and other eligibility requirements. For adults, the qualifying category may be disability, statutory blindness, or age 65 or older. Too few SSDI credits do not by themselves establish SSI eligibility.
Should I include treatment received outside Lynchburg?
Yes. List the doctors, hospitals, and clinics that treated you, including care outside the city. Include their contact information and treatment dates. SSA asks about your treatment sources, not only providers near your home.
Is a medical-record request the same as a disability application?
No. Requesting records from a health care provider obtains information about your treatment. You still need to apply for benefits through Social Security. SSA says not to delay an application because some documents are missing.
