How we help

Preparing Your Pensacola Claim With Downard

If your claim reaches an administrative law judge hearing, we develop the medical record, prepare you for testimony, and represent you at the hearing.

At the application stage, we help prepare the SSDI application and gather treatment records for the Social Security Administration (SSA). For SSI, we help complete the application and financial disclosures. Your medical history, work history, and current limitations give us a starting point for that work.

At reconsideration, we file the appeal and gather updated medical evidence, with attention to the reasons for denial. If your claim reaches an administrative law judge hearing, we develop the medical record, prepare you for testimony, and represent you at the hearing. That preparation helps you explain your limitations clearly and honestly.

We serve adults age 18 and older and work with Pensacola clients by phone or video. Our firm is based in Tennessee and has no Florida office. Our Florida disability representation page explains our statewide service.

Our service limits also address matters involving Department of Veterans Affairs (VA) benefits.

We handle SSDI cases for people who currently receive VA benefits, but we do not handle VA claims or appeals. We do not take disability cessation or continuing disability review cases, or new cases involving back-pay issues alone. We refer federal court appeals to a trusted affiliate rather than handling them in-house.

Benefit eligibility

SSDI and SSI Eligibility for Pensacola Adults

Duration rule

12months

SSDI generally requires enough recent work covered by Social Security. The work-credit requirements depend on your age when your disability began. SSA explains these insured-work requirements in its disability eligibility guidance.

SSI does not require an insured work record. Adults may qualify based on disability, statutory blindness, or age 65 or older, subject to income, resource, and other eligibility requirements. Age-based SSI does not require a disability finding.

For SSDI and adult SSI claims based on disability, SSA considers whether a medically determinable condition prevents substantial gainful activity (SGA). SGA is work involving significant physical or mental activities that is done, or usually done, for pay or profit. When the evaluation reaches those steps, SSA also considers past work and your ability to adjust to other work. The condition and the resulting inability to perform SGA must generally have lasted or be expected to last at least 12 consecutive months, unless the condition is expected to result in death. You do not have to wait a year before applying.

Initial SSI eligibility based on statutory blindness does not use SGA, and SSI statutory blindness has no duration requirement. Income, resource, and other SSI requirements still apply. SSA's SSI eligibility explanation describes the separate categories.

Local treatment records

Requesting Baptist and Sacred Heart Records in Pensacola

You can also call or visit the location where you received services.

Baptist Health Care's medical-records instructions offer an online patient request and separate channels for third parties and health care providers. You can also call or visit the location where you received services. For care at Baptist Medical Park-Nine Mile, Baptist directs records requests to the Baptist Hospital medical records department. For Baptist Medical Park-Navarre care, it directs requests to Gulf Breeze Hospital.

Baptist also provides a separate form for requesting imaging records. If your treatment included imaging, note the test and date on your records list and check the imaging instructions as well as the medical-record request instructions. Match each request to what you need rather than assuming a general request covers it.

Ascension Sacred Heart's records and portal page distinguishes hospital records from clinic records. It says most hospital medical records can be downloaded and printed from the portal, with an online request option also available. For records from a clinic location, contact that clinic directly for instructions.

Keep hospital care, imaging, and follow-up clinic visits on separate lines in your treatment list. Record the dates you need and what you have received. That makes it easier to spot a missing visit or a request sent to the wrong department.

Get organized

Build a Treatment and Work List for Your Pensacola Claim

Use the following checklist before discussing your claim. Mark anything you still need to confirm; you do not need a polished file to begin.

  • Treatment sources: List each hospital, clinic, doctor, and therapist, with contact information and approximate dates. Distinguish Baptist facility care from imaging requests and Sacred Heart hospital care from clinic visits.

  • Records requests: Note the department or clinic contacted, the records requested, the request date, and what arrived. Compare each response with the treatment dates on your list.

  • Work duties: List recent jobs and dates, then describe what each required. Include lifting, standing, driving, concentration, following instructions, or other duties your condition has affected.

  • Daily limitations: Write down specific tasks you cannot finish, breaks you need, and help you receive. Include how often the problem occurs and medication side effects you experience.

  • Claim and financial documents: Organize SSA correspondence and decisions. Record when a decision arrived. If you are seeking SSI, gather your income and resource information too.

SSA's disability application instructions explain the medical and work information to gather. For SSDI, SSA says not to delay applying because you do not have every document.

After a denial

Responding to an Initial Pensacola Disability Denial

Deadline

60days

After an initial SSDI or SSI denial, reconsideration generally must be requested in writing within 60 days after you receive the notice. SSA presumes receipt five days after the notice date unless you show that you did not receive it within that five-day period. Keep the date on the notice and the date it arrived separate.

If you miss the reconsideration deadline, you may request an extension in writing and explain why you were late. SSA must find good cause to grant more time; an extension is not automatic. The SSDI reconsideration rule and SSI reconsideration rule explain the requirements.

Read the reason for denial before deciding what to add. A missing treatment record is a different problem from a question about SSDI work-credit eligibility or SSI financial eligibility. We focus the reconsideration appeal on the reason SSA gave and the evidence needed to address it.

Where do I request Baptist Medical Park-Nine Mile records?

Baptist directs patients who received services at Baptist Medical Park-Nine Mile to the Baptist Hospital medical records department. Its records page lists the request channels. Identify the treatment location and dates when you request copies.

Do Sacred Heart hospital records include my clinic records?

Do not assume a hospital request covers clinic care. Ascension Sacred Heart provides a hospital records request option and directs patients to contact the clinic for clinic records. Follow its hospital and clinic records instructions for the care you received.

Should I wait for all my records before applying for SSDI?

No. SSA says not to delay an SSDI application because you do not have every document. Identify your treatment sources and provide the information and records you have. Its application instructions explain what to prepare.

How might I attend my Social Security hearing?

SSA has four hearing methods: in person, audio by telephone, agency video using SSA equipment at an SSA office, and online video using your own device. Online video requires your agreement. Objections to audio or agency video are subject to response deadlines and exceptions. Read SSA's hearing attendance guidance and follow your notices for how and where to appear. Our Social Security hearing-office guide is a separate resource for office details.
